Terms & conditions
These terms apply to every order. They are written to be read, not to be skipped — if anything here is unclear, ask us before you order.
Part A is the agreement between us. Part B is our full company and contact information, in the form the Electronic Communications and Transactions Act requires.
1. Who you are contracting with
Elevated Consulting Solutions (Pty) Ltd, trading as Booki, registration number 2024/439182/07. Our full details are in Part B below.
2. Who can order, and the photos you send
You must be 18 or older to order. When you tick the box on the photo step, you confirm that you are the parent or legal guardian of the child the book is for, and that we may use their photos to draw their character. Do not upload photos of a child who is not yours to say yes for.
If you add a family member to the book, you confirm that they are happy to be in it and have said you may send us their photos — or, for a brother or sister under 18, that you are their parent or guardian too. Their photos are handled exactly like your child’s.
3. Where we serve
Booki serves families in South Africa. Printed books are delivered within South Africa only; the digital story can be downloaded wherever you are.
4. How the drawings are made
To keep a character looking the same on every page, we write a short description of how they look in their approved drawing — skin tone, hair, eye colour and clothes. That description, and the photos, are sent to our illustration provider, which processes them outside South Africa, only to draw the book. The description is deleted with the rest of the book’s working files; see our photo policy.
5. How an order is made
- You choose a theme and give us your child’s details. Every Booki story carries the same life lesson, and every story is written for the same reader; neither is something you select.
- You upload photographs.
- We generate illustrated character options and you approve one. Nothing has been charged at this point.
- You review a summary of everything you have chosen, and may go back and change any of it.
- You pay. Only then does a contract come into existence.
Your order is accepted when we send you a confirmation email, not when you click pay.
6. Approving your child’s character
The approval step matters. You are shown the illustrated character at full size before any money changes hands, and you may request a different attempt or stop entirely at no cost. When you approve, you are telling us that the illustration is an acceptable likeness for this book, and we build the book around it.
This is not a promise of photographic accuracy, and we do not claim one: it is an illustration in a storybook style, not a portrait. What we do promise is that the character you approve is the character that appears in the book.
7. Adding a family member
Where the option is offered, you can add one family member to your child’s book for R149, shown in your total before you pay. Books for under-threes do not take one. Like your child, your family member is drawn from the photos you send before you pay, for you to approve, and stands beside your child on the cover and most pages.
A drawing is not a photograph, so we cannot promise a likeness. If you are not happy with how your family member looks, email info@mybooki.co.za within 14 days of delivery and we will refund the R149.
8. Taking someone out, and deleting photos
Before you pay, you can take a family member out of the book, remove photos, or cancel the whole book yourself. After you pay, email info@mybooki.co.za with your order reference and we will delete the photos you name, and the drawings made from them. This does not take away any right to cancel or be refunded that you have under these terms or the law.
9. What we will not create
We will decline any order, and refund it, where the request or the material supplied is unlawful, depicts a child in a sexual or abusive context, promotes hatred or violence, or infringes someone else’s rights. Where the law requires us to report something, we will.
10. Price and payment
The digital story is R299 and the printed hardcover is R849. These are the total amounts payable, in South African rand. We are not currently a registered VAT vendor, so no VAT is included in or added to them.
Payment is taken by Yoco. We never see or store your card details. If a price on this site is obviously wrong, we will contact you before taking payment rather than hold you to it.
11. Delivery, returns and refunds
Set out in full on our delivery and returns and refunds pages, which form part of these terms.
12. Who owns what
You own your photographs. Uploading them gives us permission to use them to make your book, and nothing more. That permission ends when the book is delivered.
You may use your book freely. Read it, print it, give it away, photograph it, put it on social media. What you may not do is resell it commercially or use our illustration style as a template to produce books for other people.
We own the underlying style and systems. The illustration style, the story frameworks and the software remain ours.
13. Personal information
Covered by our privacy policy and, for children’s photographs specifically, by how we protect your child’s photos.
Once you have paid for a book, we may occasionally email you about Booki, like a reminder before your child’s next birthday. You can unsubscribe any time.
14. When things go wrong
If we fail to deliver what you paid for, we will fix it or refund it. What we cannot accept responsibility for is loss that does not follow naturally from the order — for example, a birthday that a courier delay caused you to miss. Nothing in this clause limits your rights under the Consumer Protection Act 68 of 2008, and nothing in it limits our liability for death, personal injury or fraud.
15. Changes to these terms
We may change these terms for future orders. The terms that apply to your order are the ones in force when you placed it. Your confirmation email links to them, and your order page records the exact version that applied.
16. Law and disputes
South African law applies. If we cannot resolve a complaint with you, you may refer it to the National Consumer Commission — https://www.thencc.org.za/ — or to a South African court.
Part B — Company and contact information
The information we are required to make available under section 43(1) of the Electronic Communications and Transactions Act 25 of 2002, set out item by item in the order the Act lists them.
(a)Full name and legal status
Elevated Consulting Solutions (Pty) Ltd, trading as Booki.
A private company incorporated in the Republic of South Africa under the Companies Act 71 of 2008.
(b)Physical address and telephone number
We are a small online business. We work from a private residence and we do not operate a business telephone line, so we publish neither on this website. Everything we do is by email, and we answer there.
Our registered office address is a matter of public record at the Companies and Intellectual Property Commission against registration number 2024/439182/07. We will also give it to you directly, in writing, on request — email info@mybooki.co.za and we will send it to you.
What this means for you. Because we do not publish these two items here, section 43(3) of the Act gives you the right to cancel your order within 14 days, without giving a reason and without penalty, and to be refunded. Section 48 means nothing in our terms can take that right away from you. We would rather tell you that than quietly leave a gap.
(c)Website address and email address
info@mybooki.co.za
(d)Membership of any self-regulatory or accreditation body
We are not currently a member of any self-regulatory or accreditation body relevant to this service.
(e)Any code of conduct subscribed to, and how to access it
We do not subscribe to an external code of conduct. Our own commitments are set out in Part A above and in our child photo policy.
(f)Registration number, names of office bearers, and place of registration
Registration number: 2024/439182/07
Office bearers: Emile Pascal Nel, Allison Cindy Nel
Place of registration: South Africa
(g)Physical address for service of legal documents
For the same reason given in item (b), we do not publish an address for service on this website. It is the registered office recorded against registration number 2024/439182/07 at the Companies and Intellectual Property Commission, and we will supply it in writing to anyone who asks at info@mybooki.co.za.
The 14-day cancellation right described in item (b) applies to this omission too.
(h)Sufficient description of the main characteristics of the goods or services
Digital Storybook (PDF). An original illustrated children’s story in which your child is the protagonist, written to the theme you select. Every story carries the same life lesson and is written for the same reader; the lesson and the age it is written for are shown to you before you pay, and are not choices you make. Illustrations are generated from an illustrated character that you review and approve before you pay. Delivered as a PDF to read on screen.
Personalised Hardcover Storybook. The same story, printed and bound as a 200 × 200 mm hardcover book, with the digital edition included.
Because each book is created to your specifications, no two copies are the same and a copy cannot be resold.
(i)Full price, including transport costs, taxes and any other fees
- Digital Storybook (PDF): R299. There is no delivery charge on a digital product.
- Personalised Hardcover Storybook: R849, including delivery to a South African main centre.
- Deliveries to outlying and regional areas carry a surcharge of R199. It is shown to you, on the order, before you pay — never added afterwards.
These are the total amounts payable. We are not currently a registered VAT vendor, so no value-added tax is included in or added to these prices. If that changes, the prices shown will change with it and this page will say so.
(j)Manner of payment
Payment is by credit or debit card through Yoco, a South African payment provider. You are redirected to Yoco’s secure hosted checkout to enter your card details. We never see, handle or store your card number.
(k)Terms of the agreement, and how they may be accessed, stored and reproduced
Our full terms are Part A of this page. They are on this website in plain HTML, and can be saved, printed or copied from your browser at any time without a password or an account. Your order confirmation email links to them, and your order page records the version in force when you ordered.
(l)Time within which the goods will be dispatched or delivered
Digital story: delivered usually twenty to forty minutes — we email you the moment it is ready, with a link to download the PDF.
Printed hardcover: posted as soon as it is printed — we aim for 7–12 working days, plus courier transit time. The count starts the day your payment reaches us, because nothing is printed before it. We confirm the date by email when the book goes to print. We currently deliver printed books within South Africa only; see Delivery for the full service area.
The periods stated above are disclosed to you before you pay, for the purposes of section 43(1)(l) of the Act.
The printed hardcover window names the moment it is counted from, so that it is a determinate period and not an open-ended one. It is a target we set ourselves rather than a period agreed between us, and it therefore does not displace section 46(1): your order is executed within 30 days of the day on which we receive it. If we fail to execute your order within that time, you may cancel this agreement on seven days’ written notice under section 46(2), and where you cancel on that ground we refund you in full. Our target is the shorter period we work to inside the statutory one, and we confirm the firm dispatch date by email when your book goes to print.
(m)Manner and period in which you can access and maintain a full record of the transaction
You receive an emailed confirmation of every order containing the items, the price, the terms in force and your order reference. It is yours to keep indefinitely. You may also request a copy of your full transaction record from us at any time within three years of the order.
(n)Return, exchange and refund policy
Set out in full in our returns and refunds policy, including what we do when a book arrives damaged, when a printed book does not match the copy you approved, and how the fact that each book is made to your specification affects your rights.
(o)Alternative dispute resolution
If we cannot resolve a complaint with you directly, you may refer it to the National Consumer Commission. Complaints may be referred to the National Consumer Commission or the Consumer Goods and Services Ombud. https://www.thencc.org.za/
(p)Security procedures and privacy policy for payment, payment information and personal information
Set out in our privacy policy, and for photographs of children specifically in how we protect your child’s photos.
(q)Minimum duration, for ongoing or recurring agreements
Not applicable. Every order is a single, once-off purchase. There is no subscription, no recurring charge, and nothing to cancel.
(r)Your rights under section 44, where applicable
Section 44 of the Act gives consumers a seven-day cooling-off right on most electronic transactions. Section 42(2)(a) provides that section 44 does not apply to goods made to a consumer’s own specifications. Because every Booki story is written and illustrated around your child and your chosen theme, the section 44 cooling-off right does not apply to it.
This does not remove your other rights. The Consumer Protection Act 68 of 2008 continues to apply in full, including your right to goods that are of good quality and free of defects, and your right to a remedy where they are not. Those rights, and how to use them, are in our returns policy. We also do not begin work until you have approved your child’s character, so you see the most important part of what you are buying before you commit to it.
